Nonintervention Powers in Bellevue

Guidance for Personal Representatives Administering an Estate

Nonintervention powers can allow a Washington personal representative to administer and settle an estate with less court involvement. Kirschner Rychlick PLLC helps Bellevue families determine whether these powers may be available and how they fit into the broader administration of an estate.

Since 2010, we have provided legal services that include probate administration, will validation and contest resolution, intestate succession guidance, trust administration, and simplified options for smaller estates. Our attorneys also assist with complex estate matters, including multi-million-dollar disputes.

Eligibility for Nonintervention Powers Under Washington Law

A personal representative may petition for nonintervention powers in a testate estate, which is governed by a will, or an intestate estate, which has no valid will. Eligibility isn’t automatic. Washington law restricts certain representatives appointed under RCW 11.28.120(3), and a will may expressly direct the court not to grant these powers.

The court must also find that the estate is solvent after considering both probate and non-probate assets. Solvency generally means the estate has sufficient assets to address its enforceable debts and administrative obligations. Because some assets pass outside the probate estate, determining solvency requires careful analysis of how the property is held and transferred.

Several circumstances may qualify an estate for nonintervention powers:

  • The representative is appointed in the will admitted to probate.
  • The representative is a surviving spouse or domestic partner in a no-will estate consisting only of community property, with no qualifying issue, meaning descendants who meet the statutory criteria.
  • The representative isn’t a creditor, and granting the petition serves the best interests of beneficiaries and creditors.

A hearing on the petition may occur at the time of appointment or later during administration. Probate filings for a decedent from the Bellevue area are made in the superior court serving the region. Before seeking authority from the court, we can evaluate the will, the representative’s status, estate assets and debts, and the interests of beneficiaries and creditors.

Probate Administration for Bellevue Estates

Nonintervention authority is one part of administering an estate, not a substitute for it. We guide probate matters from filing the will through completion, including identifying and valuing assets, paying debts and taxes, distributing property, and taking the required steps to close the estate.

Probate work, trust administration, and non-probate assets are distinct but related areas. An estate may include property controlled by the representative, assets managed by a trustee, and accounts or property that transfer outside probate. When these areas intersect, we coordinate them to give the client a single point of contact.

Coordination with Interested Parties

Depending on the estate, we coordinate with the regional superior court, trustees, financial institutions, and beneficiaries. This work may include confirming who controls an asset, determining how it passes, and resolving questions that affect distribution or estate closure. We tailor our approach to the circumstances of each administration.

Will & Intestate Estate Issues

A disputed will, uncertainty about its validity, or disagreement among interested parties can change the course of administration. We handle will validation and contest resolution when those issues arise. If there’s no valid will, we provide intestate succession guidance concerning the legal order in which estate property passes.

Discuss the Estate with Our Probate Attorneys

A free consultation or case evaluation is an opportunity to discuss the estate, the proposed representative, and whether nonintervention powers may be appropriate. We can also identify related probate, trust, and asset-transfer issues that may require coordinated attention.
